Õiguspärase ootuse kaitse põhimõtte eeldused ja piirid Euroopa Liidu õiguses

Abstract

Euroopa Liidu (EL) õigusele vastav lahendus leitakse sageli ELi õiguse üldpõhimõtete abil. Doktoritöös uuritakse ühte ELi õiguse üldpõhimõtet – õiguspärase ootuse kaitse põhimõtet. Iga isik, kellele ELi institutsioon on tekitanud põhjendatud lootusi, võib tugineda õiguspärase ootuse kaitse põhimõttele. Doktoritöö eesmärk on välja selgitada õiguspärase ootuse kaitse põhimõtte võimalikud piirid ELi õiguses. Põhimõtet on rikutud, kui täidetud on kolm eeldust: ELi institutsioon on tekitanud isikule põhjendatud lootusi; kehtiva olukorra muutmine ei olnud isikule ettenähtav; puudub avalik huvi, mis kaaluks üles isiku põhjendatud lootused. Töös jõutakse järeldusele, et ülekaalukas avalik huvi ei ole olulist rolli mänginud isiku õiguspärase ootuse kaitse kõrvale jätmisel. Kui õiguspärase ootuse kaitsmise väärimist on Euroopa Liidu Kohus leidnud harva, siis mittekaitsmise põhjused peituvad eelkõige asjaolus, et isikule ei ole tekitatud põhjendatud lootusi ja kehtiva olukorra muutmine oli ettenähtav. Ettenähtavuse kriteeriumiga seoses on nõuded ettevõtjale väga kõrged. Õiguspärase ootuse kaitse põhimõte kohaldub Euroopa Liidu õiguses kitsastes piirides. Kui mõelda kõige peamisele piiripostile, s.o õigusriigi põhimõttest tuletatud õiguskindluse põhimõttele, mis nõuab õiguspärase ootuse kaitset, siis see nõue on ELi õiguses täidetud, kuid minimaalsel tasemel. Samas võib öelda, et kuigi õiguspärase ootuse kaitse on raskesti saavutatav, on õiguspärase ootuse kaitse põhimõte kui ELi õiguse üldpõhimõte Euroopa Liidu Kohtu praktikas praeguseks ajaks küllalt detailselt välja arendatud. Üle poole sajandi on Euroopa Liidu Kohus kõnealust põhimõtet kujundades otsinud tasakaalu ELi huvide ja erahuvide vahel ja on töö autori hinnangul isikut kaitsvat põhimõtet ‒ õiguspärase ootuse kaitse põhimõtet kujundades, arvestanud tugevalt ELi huve.
A solution compliant with EU law is often found with the help of the general principles of EU law. This doctoral thesis focuses on one general principle of EU law: the principle of the protection of legitimate expectations. The right to rely on the principle of the protection of legitimate expectations extends to any person with regard to whom an institution of the EU has given rise to justified hopes. The purpose of this doctoral thesis is to identify the possible limits of the principle of the protection of legitimate expectations in EU law. The principle is breached if three conditions are met: an institution of the EU has caused a person to entertain justified hopes; the change of the existing situation was not foreseeable to the person; and there is no public interest that would override the justified hopes of the person. The author of this thesis concludes that the public interest has not played a significant role in leaving aside the protection of legitimate expectations of persons. While the Court of Justice of the European Union (CJEU) has found legitimate expectations rarely worthy of protection, the reasons for not protecting it lie, above all, in the fact that no justified hopes have been given to a person and the change of the current situation was foreseeable. In connection with the foreseeability criterion requirements for economic operators are very strict. The principle of the protection of legitimate expectations is applicable in EU law within narrow limits. As for the main milestone, i.e. the principle of legal certainty derived from the principle of the rule of law, which calls for protection of legitimate expectations, this requirement is fulfilled in EU law, albeit at the minimum level. At the same time, one can argue that even though the protection of legitimate expectations is difficult to achieve, the principle of the protection of legitimate expectations as a general principle of EU law has been developed to a quite detailed level in the case-law of the CJEU by the present time. The CJEU has been looking for a balance between the interests of the EU and private interests for over a half a century in shaping the principle and, in the estimate of the author of this thesis, the CJEU has vigorously upheld the interests of the EU upon shaping this individual-protecting principle of the protection of legitimate expectations.
