Kirje Ladina päritolu juriidilised terminid Eesti õiguskeeles(2006) Ristikivi, Merike; Lill, Anne, juhendajaKirje Latin terms in the Estonian legal language: form, meaning and influences(2009-12-17T06:27:19Z) Ristikivi, MerikeThe thesis concentrates on the usage of Latin terms in Estonian-language legal text and analyses, primarily on the basis of juridical journalism, the impact of the radical reforms of Estonian legal order in the 20th and 21st centuries on legal terminology. In the period under observation, conceptual changes occurred in the legal order, which also had an effect on legal culture. Legal culture, in turn, finds expression in legal language, a part of which is terminology originating from Latin. The objective of the doctoral thesis was to examine the linguistic and social aspects that have influenced legal language, as well as the relationship between those aspects, analysing Latin terms as a means of signifying legal structures, relationships, values and changes in the context of legal reforms, used by authors of juridical publications; to bring out, on the basis of the impact of the social aspect, the changes in political power and legal system as mirrored in the usage of terminology by lawyers in their articles; to identify the practical problems and language errors in the usage of Latin terms; to juxtapose the state of juridical education in the periods under observation as reflected in the usage of Latin legal terms. The analysis conducted in the framework of the doctoral thesis helped to establish the peculiarities and dynamics of the usage of Latin terms in legal language. Extra- and intra-linguistic factors became evident. The target language, i.e. Estonian, has an influence on the orthography and syntactic parameters in texts about law. The results of the research study differentiated the main hypothesis of the thesis concerning the impact of changes in political power on legal terminology. The analysis indicated that changes in the usage of Latin terms accompanied the major ideological and law related upheavals. However, not all changes in the ideology of power brought about changes in the usage of the language and vocabulary of lawyers. The research material revealed that a key factor that influences the usage of Latin legal terms is also education.
