The aim of this thesis was to create a framework in which to understand the debate over the limits of free speech in law, give an overview of few positions in this framework and finally see if offensiveness could be a suitable criterion for limiting free speech. I propose that there is a fundamental contradiction between the values of free speech and equality which forms the backbone of the debate. Thus, three possible positions form on the matter: for free speech over equality, for equality over free speech, or compromise without sacrificing either too much.
